How Does The New York State Audit Process Work?
NYS audits can be fairly limited or very broad, and they can focus on more than one kind of tax issue at a time. Complexity and scope can vary greatly. In general, however, you can expect the audit process to evolve like this:
Audit Selection
Discrepancies between forms, unusual deductions, mistakes with tax credits and even relocation to another state can trigger an audit. Selection can also be entirely random or because you fall into a category that is statistically tied to tax errors and fraud.
Audit Notification
You will first become aware of the New York State Department of Taxation and Finance’s interest in your taxes when you receive a notice informing you of the audit. Typically, you’ll be given information about the audit’s scope, the documentation you need and the time frame involved.
Documentation Gathering
You will need to gather the majority of your tax records for inspection. You may need everything from bank records and credit card receipts to your invoices and payroll records. If you have been selected for a desk audit, you will need to deliver all the requested documents to the auditor’s office. If you have been selected for a field audit, the auditor will come to your business to review the documents.
Examination Period
The auditor will conduct a thorough examination of your records and returns. During that time, you may be required to submit additional information and documents per the auditor.
Findings And Adjustment Proposal
Once the examination is complete, the auditor will present their findings. If the examiner feels that there were mistakes, they will propose an adjustment.
Acceptance Or Appeal
If you agree with the auditor’s findings, you can accept them and simply pay the bill. If you cannot afford the whole bill at once, you may then consider installment payments or make an offer in compromise. If you disagree with the auditor, you have the opportunity to file an appeal.
Appeal Exploration
There are several possible approaches to take when you disagree with an auditor’s findings. You can try to reach a better agreement through an informal courtesy conference. You can also ask for mediation through a conciliation conference, file a request for a hearing with an Administrative Law Judge (ALJ) or ask for a court review.
Appeal Resolution
Once the Division of Tax Appeals issues its final assessment, you may or may not still owe a tax bill. If you do owe taxes, you will need to make appropriate payment arrangements to resolve the debt and move forward.
